Welcome to USE I.T (referred to as “we”, “us”, “our”). We operate this online store and website (and all related content, products, services and features) to provide you (the “customer” or “you”) a curated shopping experience (the “Services”). Our store is powered by Shopify and fulfilled via Printful — therefore, you acknowledge that we use Printful’s print-on-demand fulfilment model and these Terms of Service (“Terms”) govern your use of the Services.
By accessing, browsing or placing an order through our Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree with these Terms or the Privacy Policy, please do not use or access our Services.

1. Access and Account

By agreeing to these Terms you represent that you are at least the age of majority in your jurisdiction (state or province) or you have obtained parental/guardian consent for any minors using the Services through your account.
To use the Services (including browsing the store or placing orders), you may need to provide certain information such as email, billing/payment details, shipping address. You represent that all information you provide is true, current, and complete, and you have all rights and permissions necessary to provide that data.
You are responsible for maintaining the security of your account credentials and you are fully responsible for all activity under your account. You may not transfer, sell, assign or license your account to any other person or entity.

2. Our Products

We endeavour to provide accurate descriptions of our products, including images and colours; however, due to device settings, printing variations, or fulfilment via Printful, product colours, textures or finishes may differ slightly from what you see on screen.
Because our products are produced on-demand, we do not guarantee that the appearance, quality or fit will meet your expectations exactly. All product descriptions, specifications and availability are subject to change at our discretion without notice. We may discontinue any product at any time and may limit quantities or fulfilment to certain geographies or jurisdictions.

3. Orders

When you place an order, you make an offer to purchase. We reserve the right to accept or decline any order in our discretion. Your order is not accepted by us until we send you a confirmation of acceptance. Payment must be approved and processed before acceptance.
Please review your order carefully before submitting: once production begins via Printful, cancellation or modifications may not be possible. If we do not accept your order (for any reason), we will notify you by email using the contact information you provided.
You agree that your purchase is for your personal or household use, not for commercial resale or export, unless explicitly agreed otherwise.

4. Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time your order was placed and shown in your order confirmation. Unless explicitly stated, posted prices do not include taxes, shipping, handling, customs or import duties.
Prices on our website may differ from physical stores or other online platforms. Promotions may have additional terms which take precedence over these Terms.
You agree to provide current, complete, and accurate payment and account information. You represent and warrant that (i) the payment method is valid and authorized, (ii) you are authorized to use the payment method, (iii) the charges will be honored by your payment issuer, and (iv) you will pay all charges incurred at the posted price including shipping/handling, taxes and duties.

5. Shipping and Delivery

Our Products are printed and shipped via Printful and/or their fulfilment partners. All shipping and delivery times are estimates only and not guaranteed. We are not liable for shipping delays caused by carriers, customs, import procedures, acts of God or events outside our control.
Once your order is transferred to the carrier, the title and risk of loss pass to you.

6. Intellectual Property

The Services, including trademarks, logos, text, images, graphics, videos, audio and the selection and arrangement thereof, are owned by us, our affiliates or licensors and are protected by applicable intellectual property laws.
Your use of the Services is for your personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, download or transmit any part of the Services without our prior written permission. Nothing in these Terms grants you a licence to our intellectual property or that of Printful or any third party. Unauthorized use may violate IP laws.

7. Optional Tools

We may provide access to third-party tools (apps, widgets, extensions) as part of the Services. You acknowledge and agree that we neither monitor nor control these tools, and you access them at your own risk. We provide them “as is” and “as available” without warranties.
Your use of any optional tool is subject to the terms of the third-party provider(s). We may add new features in future; they will be subject to these Terms.

8. Third-Party Links

Our site may contain links to third-party websites or resources. We do not endorse or control those third parties and are not liable for any content, changes or services they provide. If you leave our domain to access such material, you do so at your own risk. We are not responsible for any damage or loss arising from your use of third-party sites, products or services.

9. Relationship with Shopify

Our store is powered by Shopify. However, any sales you make are with us (USE I.T). By using the Services you agree that Shopify is not responsible for any aspect of your purchase, including product quality, fulfilment, delivery, legal compliance or liability. You expressly release Shopify and its affiliates from all claims arising from or related to your purchase through us.

10. Privacy Policy

All personal information collected through the Services is subject to our Privacy Policy [LINK] and possibly Shopify’s privacy policy. By using the Services you acknowledge you have read and accepted those policies.
Because the Services are hosted via Shopify and fulfilled via Printful (global operations), your data may be processed in countries other than where you reside. Please review the Privacy Policy for details.

11. Feedback

If you submit ideas, suggestions, reviews or other content to us (“Feedback”), you grant us a worldwide, royalty-free, sublicensable, perpetual licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose (including commercial use).
You warrant that you own or have permission to use the Feedback, that it’s not confidential, that you’ve disclosed any compensation received, and that it complies with these Terms.
We may monitor, edit or remove Feedback at our discretion. We are under no obligation to respond or pay compensation.
You agree that Feedback will not infringe any third-party rights, contain unlawful or abusive content, or transmit malware. You’re responsible for its accuracy.

12. Errors, Inaccuracies and Omissions

Occasionally information in the Services (product descriptions, pricing, shipping, promotions or availability) may contain typographical errors, inaccuracies or omissions. We reserve the right to correct any error, change or update information or cancel orders if information is inaccurate, even after you have submitted your order.

13. Prohibited Uses

You may use the Services only for lawful purposes. You must not:
a) use the Services for any illegal or unauthorized purpose;
b) violate any laws, rules or regulations;
c) infringe our or others’ intellectual property rights;
d) harass, abuse or harm other users or our staff;
e) transmit false or misleading information;

g) impersonate any person or entity;
h) interfere with the security features of the Services;
i) engage in any other conduct that may harm the Services, other users, us or expose them to liability.
In addition, you agree not to upload viruses or malicious code, reproduce or exploit any portion of the Services, collect personal information of others without consent, spam, crawl/scrape the site, or bypass security features. We may suspend or terminate your account at any time without notice for violations.

14. Termination

We may terminate this agreement or your access to the Services (or any part thereof) at our discretion, without notice. You will remain liable for amounts due up to the date of termination.
Sections that by their nature survive termination (e.g., Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Governing Law) will continue to apply.

15. Disclaimer of Warranties

The Services and all products are provided “as is” and “as available,” unless expressly stated otherwise by us. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not guarantee uninterrupted, timely, secure or error-free use of the Services. Some jurisdictions may not allow certain disclaimers, so they may not apply in your case.

16. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall we, our affiliates, directors, officers, employees, agents, service providers, licensors or Shopify or Printful be liable for any indirect, incidental, special, punitive or consequential damages (including loss of profits, savings, data or business interruption) arising from your use of the Services or any product, even if advised of the possibility of such damages.

17. Indemnification

You agree to indemnify, defend and hold harmless USE I.T, Printful, Shopify and their respective affiliates, officers, directors, employees, agents, licensors and service providers from and against any losses, liabilities, claims, damages, costs or expenses (including reasonable legal fees) arising out of:

your breach of these Terms or any referenced policy;
your violation of any law or the rights of a third party;
your access to or use of the Services.

We will notify you of any indemnifiable claim, provided that your failure to promptly notify us will not relieve you of your obligations, unless materially prejudiced. We may control the defence and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defence of such claims.

18. Severability

If any provision of these Terms is held unlawful, void or unenforceable, that provision shall be deemed severed from these Terms and will not affect the validity of the remaining provisions, which will remain in full force.

19. Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms (together with our Privacy Policy and any referenced policies) constitute the entire agreement between you and us regarding your use of the Services and supersede all prior agreements, communications and proposals (whether written or oral) between you and us.
Any ambiguity in interpreting these Terms shall not be construed against the drafting party.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent; any attempt by you to do so will be null and void. We may freely assign, transfer or delegate these Terms and our rights and obligations without obtaining your consent.

You and us agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.

We reserve the right, in our sole discretion, to update, change or replace any part of these Terms by posting updates on our website.
